The UK's Information Commissioner's Office (ICO) has launched a formal investigation into X (formerly Twitter) and its AI subsidiary, xAI, concerning the Grok AI chatbot. This probe focuses on Grok's processing of personal data and its use in generating harmful, sexualized image and video content. This regulatory action adds to a challenging period for Elon Musk's social media platform.

The ICO's announcement, made earlier this year, follows a "Grok nudification trend" that emerged on X in January. During this period, hundreds of thousands of sexualized images were reportedly shared publicly on the app daily. This widespread issue prompted authorities in various regions to implement restrictions on Grok and call for X to remove the problematic functionality, urging the platform to address the misuse of its AI tool.

Initially, X owner Elon Musk resisted these calls, asserting that the actions were politically motivated and aimed at silencing X due to its "free speech" approach. He argued that other AI tools offered similar "nudification" capabilities and that Grok was being unfairly targeted. However, X's significant scale and reach made it a primary focus, even as other applications faced similar investigations. X eventually moved to restrict the option, which largely curbed the "Grok nudification trend." Despite these measures, investigations have found that Grok can still produce sexualized depictions of individuals when prompted.

ICO's Investigation Details

The ICO's investigation aims to gain further insight into X's operations. As per the ICO's statement:

“During this investigation, the ICO will assess XIUC and X.AI’s compliance with UK data protection law in respect of the processing performed by the Grok AI system. The ICO has not reached a view on whether there is sufficient evidence of an infringement of data protection law by X.AI or XIUC. If we find there is sufficient evidence of such an infringement, we will consider any representations we receive before taking a final decision as to whether data protection law has been infringed and what action, if any, is appropriate.”

This ongoing inquiry suggests that X could be facing yet another significant penalty in Europe, depending on the outcome.

The UK investigation is not an isolated incident. French authorities also raided X's local office in Paris as part of their own ongoing inquiry into similar concerns.
